Challenging a Will (or Intestacy)

Not every family is united in grief when a loved one dies.

On occasions a challenge is made to a Will. Family members may do so for a variety of reasons, such as:-

1. They have received nothing in the Will & think that they should have received something.

2. They believe that they deserve more than they have been given in the Will.

3. They believe that the Will is defective in some way, such as:-
     a. not signed by the deceased
     b. signed under pressure from others
     c. did not have the capacity to make a Will

On other occasions a family member may challenge the fact that the rules of intestacy (which apply when someone dies without making a Will) have left them with very little or nothing at all.
